Lil Durk Felony Charges From 2019 Have Been Dropped

 

On February 5th, 2019, Lil Durk & King Von were involved in a shooting with Alexander Whitherspoon in Atlanta. The rappers were wanted for five felony charges, including aggravated assault, criminal intent to commit murder, possession of a firearm during commission of a felony, possession of a firearm by a convicted felon, and criminal street gang association.

A court document was released today from the Superior Court of Fulton County State of Georgia stating, "The facts of this case have been reviewed and, although it appears that probable cause existed for the defendant's arrest, the decision of the District Attorney at this time is NOT TO PROSECUTE the above named defendant (Durk Banks) for charges arising from case number 19CP183973. The reasons for this decision are as follows: Prosecutorial Discretion"


Prosecutorial discretion is when a prosecutor has the power to decide whether or not to charge a person for a crime, and which criminal charges to file. This is a rather broad power that also gives prosecutors the authority to enter into plea bargains with a defendant, which can result in the defendant pleading guilty to a lesser charge or receiving a lesser sentence for pleading guilty to the original charge.
